This section explains how law enforcement and government agencies may request information.

5.1 How to Submit a Request

Send requests in writing by email to contact@kissmah.com with the subject line “Law Enforcement Request,” or by mail to kissmah, 18 Upper Brook Road, Sparrow Bush, NY 12780.

  • Requests must come from an official agency email address or be on official letterhead, and must include the requesting officer’s name, badge or ID number, agency, direct contact details, and the case or reference number.
  • Requests must identify the specific person or account and the specific information sought, and must cite the legal authority for the request.

5.2 Legal Process Required

We disclose personal information only in response to valid legal process, such as a subpoena, court order or search warrant issued under applicable U.S. federal or New York law, or where otherwise required by law. We may require a higher level of legal process for more sensitive information. We do not accept requests through social media, phone or informal channels.

5.3 Our Review

We review every request for validity, scope and jurisdiction. We may reject or narrow requests that are overbroad, unclear or not legally valid. We may seek clarification, and we may object to or challenge requests where appropriate.

5.4 Emergency Requests

If a situation involves an imminent threat of death or serious physical harm to any person, an authorized official may submit an emergency request, marked “EMERGENCY” in the subject line, to contact@kissmah.com with a description of the emergency. We will review it on an expedited basis and may disclose limited information needed to address the emergency. In any life-threatening emergency, contact 911 first.

5.5 User Notice

Unless prohibited by law or a court order, or unless doing so could endanger a person or compromise an investigation, we will notify the affected user before disclosing their information so they can seek legal protection.

5.6 Preservation Requests

On receipt of a valid written preservation request from law enforcement, we will take reasonable steps to preserve relevant account records for 90 days, extendable once for a further 90 days on a renewed request, while legal process is obtained.

5.7 What We Can Provide

Depending on the request and legal process, information may include registration details, verification records, event attendance records and communications with us. Payment card and PayPal account details are held by Stripe and PayPal and not by kissmah; requests for payment data may be directed to those companies.

5.8 Reporting Unlawful Activity

We may proactively report suspected unlawful activity, including threats, fraud, harassment or harm to others, to the appropriate authorities.
