Owned and operated by Rikiat White, a sole proprietorship based in the United States, doing business as Kissmah (“kissmah,” “we,” “our,” “us”).
1.1 Acceptance of Terms
These Terms and Conditions (“Terms”) govern your use of the kissmah website (www.kissmah.com) and the kissmah mobile application (together, the “Services”). By creating an account, registering for an event, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1.2 About kissmah
kissmah is a trusted platform for people seeking serious, marriage-focused relationships. kissmah hosts private and secured events for those who are ready to find a life partner. kissmah is not a casual dating application.
1.3 Eligibility
- You must be 21 years of age or older.
- You must be a verified resident of the United States.
- You must be genuinely seeking a marriage-focused relationship.
- You must provide accurate, current and complete information and a valid government-issued ID for verification.
We may decline or cancel any registration that does not meet these requirements or that we cannot verify.
1.4 Free Registration, Verification and Invitations
Registering with kissmah is free. To register, you submit your information and a valid government-issued ID, which we use solely to verify your eligibility and your identity at the event. A formal invitation email will be sent within three (3) weeks of complete registration. Receiving an invitation is not guaranteed; we may decline any registration that does not meet our requirements. Venue locations are confidential and are disclosed only through the official invitation.
1.5 Fees and Payment (Pay Only for Invitations You Accept)
You pay only for invitations you accept. There is no charge to register, and no charge if you decline or do not respond to an invitation. Invitation fees start at $250 and are shown on the invitation and at checkout before you pay. Payments are processed securely by our third-party payment processors, Stripe and PayPal. Fees, refunds and payment terms are described in our Pricing and Refund & Payment Policy, which form part of these Terms.
1.6 “No Match, Free Second Event” Guarantee
If you do not find a match at your first event, you may attend one (1) additional event at no further invitation fee. The guarantee applies once per paid invitation, is subject to availability and your continued compliance with these Terms and the Acceptable Use Policy, and has no cash value.
1.7 Conduct at Events
Attendees must carry valid ID, treat other guests and staff with respect, and follow instructions from event staff and venue partners. We may remove any person from an event, without refund, for conduct that violates these Terms or the Acceptable Use Policy.
1.8 Event Photography
Photographs may be taken at events for marketing and promotional purposes. You may opt out of promotional use by emailing us before the event or by identifying yourself to event staff on site. See the Privacy Policy, Section 6.5, for details.
1.9 No Guarantee of Outcome
We provide a safe, verified setting that facilitates meaningful introductions. We do not guarantee that you will meet a match, form a relationship or marry. We do not endorse any attendee and are not responsible for the statements, conduct or intentions of other attendees. You are responsible for your own judgment and safety when meeting others.
1.10 Intellectual Property
The kissmah name, logo, app, website content and event materials are owned by or licensed to us and may not be copied, modified or distributed without our written permission.
1.11 Suspension and Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if you breach these Terms, provide false information, or put the safety or privacy of others at risk. You may stop using the Services at any time and may request deletion of your data as described in the Privacy Policy.
1.12 Prohibited Conduct and Zero-Tolerance Safety Policy
kissmah is committed to a safe community and strictly prohibits, with zero tolerance, human trafficking and sex trafficking, and aiding, encouraging or facilitating the abuse or exploitation of any person. We also prohibit child sexual exploitation and abuse (CSEA) and child sexual abuse material (CSAM), sexual violence, sexually explicit profile or other content, and sexually driven interactions of any kind, including consensual exchanges. These and other prohibited activities are described in our Acceptable Use Policy, which forms part of these Terms. We will terminate offending accounts and report suspected child exploitation to the National Center for Missing & Exploited Children (NCMEC) and suspected trafficking or other crimes to law enforcement, as described in our Law Enforcement Protocols.
1.13 Disclaimers and Limitation of Liability
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, and we are not liable for indirect, incidental, special or consequential damages arising from your use of the Services or attendance at events. Our total liability for any claim is limited to the amount you paid us for the invitation fee giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
1.14 Indemnification
You agree to indemnify and hold harmless kissmah, Rikiat White, and our staff and venue partners from claims, losses and expenses arising from your breach of these Terms or your misuse of the Services.
1.15 Governing Law and Disputes
These Terms are governed by the laws of the State of New York and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute shall be brought in the state or federal courts located in New York, and you consent to their jurisdiction. Before filing a claim, you agree to contact us and try in good faith to resolve the matter informally.
1.16 Changes to These Terms
We may update these Terms from time to time. Material changes will be notified by email or by a prominent notice on the website or app. Continued use of the Services after changes take effect means you accept the updated Terms.
